Mediator Ira S. Bergman is a Florida Supreme Court Certified Circuit Civil Mediator. He began his legal career almost 30 years ago as a judicial law clerk at the 15th Circuit in West Palm Beach, and thereafter worked as an insurance litigator in New York City and Philadelphia. He returned to South Florida in 2007, where he continued to litigate a wide range of insurance cases, both first-party and third-party.
Mr. Bergman’s multi-faceted background as a coverage attorney makes his perspective on mediation unique. Mr. Bergman has a deep understanding of the insurance industry and the factors that motivate both claimants and insurers to settle cases. By establishing rapport with the parties through candid communications, he develops effective resolution plans that are acceptable to opposing parties in mediation.
Throughout his career, Mr. Bergman has developed and executed strategic resolution plans for thousands of pre-litigation disputes and litigated cases. He has undertaken multiple roles in the mediation process as decision-maker, mediator and counsel of record. Mr. Bergman’s most satisfying work has been the facilitation of negotiated resolutions of multi-party disputes.
As an insurance coverage lawyer, Mr. Bergman advised insurers regarding appropriate handling and resolution of matters across the country. He has drafted policy language, managed coverage and bad faith litigation, and represented insurers in a wide range of coverage disputes and litigation. His coverage litigation experience is highly diverse, spanning first-party coverage litigation over damage caused by Hurricanes Wilma and Irma, third-party coverage litigation concerning liabilities arising out of asbestos, lead paint, tobacco and construction defects, and many other types of insurance disputes.
This coverage experience and expertise adds value to the resolution process, allowing Mr. Bergman to understand and address insurance coverage positions that might pose an obstacle to resolution. Mr. Bergman’s expertise includes property, liability, and automobile coverage, regulatory compliance, and good faith claim handling country-wide.
