Arbitration Mediation
Arbitration mediation—often referred to as “med-arb”—is a hybrid process combining two forms of alternative dispute resolution. First, parties attempt to settle their conflict through mediation, guided by a neutral facilitator who encourages dialogue and compromise. If that fails, the same or a different neutral steps into an arbitration role, reviewing evidence and issuing a binding decision. This structure ensures efficiency: even if talks stall, the dispute won’t drag on indefinitely. It’s commonly used in commercial, labor, and construction disputes. This dual-track method offers the flexibility of mediation with the finality of arbitration—striking a balance between control and closure.
