Mediate Lawsuit is a tradename of Lawsuit.com, LLC, a Delaware limited liability company.
Please read carefully: Your use of and access to the web platform and services is subject to and conditioned on accepting these terms. Please take the time to read the full terms and conditions as your use of the mobile platform will be subject to them. Mediate Lawsuit services are not available to any person or persons who are not legally eligible to be bound by these terms and conditions.
Mediate Lawsuit wants you to enjoy all the benefits of its mobile platform ("MLP"). We believe that it will be helpful to you for collecting, storing, accessing, and sharing information as it relates to your digital presence, which you will find is invaluable to helping you maximize your digital exposure. Please read the following terms and conditions carefully which inform you of your rights and limits pertaining to this Platform.
Services
By accessing or using the Platform, you agree to be bound by these terms and conditions. Subject and conditioned on these terms, Mediate Lawsuit grants you a limited, non-exclusive, non-transferable, and revocable right and license to use Mediate Lawsuit Platform, content, and services for your professional and commercial use. You agree that you will not, unless specifically permitted by Mediate Lawsuit in writing, (a) copy, display, resell, or distribute any part of the information contained in the mobile Platform; (b) alter or modify any part of the Mediate Lawsuit Platform other than as may be reasonably necessary to use the platform for its intended purposes; (c) install, post, or distribute any information contained in the platform to any third-party networks; or (d) engage in any activity or use that could damage, disable, overburden, impair, or otherwise interfere with or disrupt the Platform. If you do not agree to these terms and conditions, you should immediately discontinue use of the Platform.
Not Intended for Legal Advice
Mediate Lawsuit and its Platform are not intended for legal advice and Mediate Lawsuit disclaims any and all statements that may be misinterpreted or misunderstood by you to be legal advice. Rather, Mediate Lawsuit is providing a method to connect you with mediators who can assist you with any legal matter that you may have against or with another. You should always consult an attorney to answer any legal questions that you may have. Mediate Lawsuit may suggest a list of attorneys; however, this list may not reflect the current status of any of these attorneys. Please check with the appropriate state bar agency to ensure that the attorney is active and in good standing.
Registration
In order to access certain features of the Platform, you may be required to register and create a user profile ("Account"). This may include, but is not limited to, creating a unique username and password, providing personal information, and answering certain questions. Your account must be used by you and only you in connection with the Platform. You are responsible for maintaining the confidentiality of your Account and password. You are further responsible for any and all activities associated with your account. You agree that you will not share, sell, or transfer your Account information to other person or make it available to multiple users. You hereby agree that (a) all information provided by you is true, accurate, and current, and (b) all information will be maintained and promptly updated by you.
Updates
Mediate Lawsuit may, at any time and at its sole discretion, discontinue or modify the features found in the app. Further, Mediate Lawsuit reserves the rights, at its sole discretion and without notice, to change, modify, add, or delete any portion of these terms and conditions at any time. Please check these terms and conditions regularly for any changes. Your use or continued use of the Platform constitutes your agreement to any of these changes. Changes to this Platform will be posted on this page with effective date of the change.
Backup
It is your responsibility to store any information in a separate and secure database in case of any disruption, malfunction, or disablement of the platform. The information stored on the platform can be stored in your hardware, memory card, in the cloud, or elsewhere. Mediate Lawsuit cannot guarantee that this information will be secure, will not be corrupted, or will be available to you later. It is your sole responsibility to have a backup system, including but not limited to, a physical copy of all information stored in this Platform.
Proprietary Rights
Mediate Lawsuit retains all ownership of all proprietary rights in the Services (as defined in paragraph 1) and app including all trademarks, trade names, service marks, logos, and domain names.
Advertisement and Promotions
Mediate Lawsuit may run advertisement and promotions from third-parties on the Platform. Your business dealings or correspondence with, or participation of, any advertisers other than Mediate Lawsuit are solely between you and such third party. Mediate Lawsuit is not responsible for any loss or damage resulting from any such engagement with a third party advertiser. Please conduct your own research before engaging with any third party advertisers.
Termination
Mediate Lawsuit may terminate or suspend the Services provided to you at any time and without notice to you. Without limiting the foregoing, Mediate Lawsuit has the right to immediately terminate your Account in the event your use of the site is considered, in Mediate Lawsuit's sole discretion, to be unacceptable, unlawful, in breach of these terms and conditions, or otherwise violates company policy.
No Warranties
The services and Platform are provided "as is" and Mediate Lawsuit, its affiliates, and distributors expressly disclaim all warranties of any kind, express or implied, including but not limited to any warranty of merchantability, fitness for a particular purpose or non-infringement. Mediate Lawsuit does not warrant in any way that it will meet your requirements, be uninterrupted, secured, or error free. Use of the Platform is at your sole risk. Any materials downloaded or uploaded will be at your own discretion and risk. Mediate Lawsuit does not assume any risk for retention of any information or communication. Your sole remedy against Mediate Lawsuit is to stop using its services or Platform.
Export Restriction
You agree that the services or any portion thereof is subject to export controls laws of the United States. You will not export, re-export, divert, transfer or disclose any portion of the services in any related technical information or materials, directly or indirectly, in violation of any applicable export laws or regulations.
Privacy
Mediate Lawsuit and the platform is subject to Mediate Lawsuit's privacy policy. You agree that Mediate Lawsuit may contact you via email or otherwise with information relevant or may be useful to you. You agree that your name, email address, or both may be listed in the header of certain communications you initiate through the Platform.
Arbitration
Mediate Lawsuit and you agree that these terms and conditions are governed by the Federal Arbitration Act. In the event of a dispute, claim, or controversy arising from these terms and conditions, you must give Lawsuit.com notice of the dispute, claim, or controversy. Lawsuit.com will attempt to resolve any dispute, claim, or controversy, but if the parties fail to do so, the parties agree to resolve any dispute through arbitration in South Florida.
Waiver and Severability
Failure by either party to exercise its rights under this agreement will not be deemed a waiver or forfeiture of such rights or ability to enforce such provisions. If any provision is held to be illegal, invalid, or unenforceable, that provision will be amended to achieve as nearly as possible the same effect of the original provision and the remaining agreement will be in full force and effect.
