Mr. Scott Maker is a seasoned litigator who knows from instinct and experience that mediation is typically the best way to resolve disputes. For 15 years, as a litigator in private practice at Pierce Atwood, Maine’s largest law firm, Scott tried a wide variety of cases, including product liability, personal injury, and business disputes involving both state and federal law.
After leaving private practice, Scott served for 25 years in various in-house counsel roles at a Fortune 500 financial services company, including as Chief Regulatory Counsel, Chief Government Affairs Officer, and Deputy General Counsel overseeing and directing all company litigation.
In both private practice and as a corporate attorney, Scott’s ability to evaluate the merits of various claims, identify the strengths and weaknesses of each case based on both the facts and the law, and assess the demands and needs of the parties helped him hone the skills and insights necessary to be an effective neutral/mediator.
Scott has a wide ranging mediation practice, with a particular focus on the resolution of disputes concerning employee benefits, including disability, life, accident and long term care insurance issues, most of which are governed by ERISA. Scott’s long history and experience in this industry has earned him the respect and trust of counsel representing both plaintiffs and defendants, and he has created an enviable track record of helping to resolve even the most difficult cases in this specialized legal field.
Mediation is a voluntary, non-binding, and confidential process in which the parties, aided by an impartial mediator, resolve their dispute together before trial or an appeal, and in some instances, before the commencement of litigation. Throughout this process, an impartial mediator works with the parties to help negotiate a mutually satisfactory resolution.
