What makes a medical-malpractice or products-liability case especially hard to settle, and how does mediation help?
These cases are expert-driven and expensive, and both sides usually have credible experts who flatly disagree.
These cases are expert-driven and expensive, and both sides usually have credible experts who flatly disagree. In Alabama medical-liability cases, the plaintiff generally has to prove the standard of care through a 'similarly situated' health-care provider under the Alabama Medical Liability Act, and the pleading and proof requirements are strict — which raises the stakes, the cost, and the uncertainty for everyone. Products cases turn on design, warnings, and causation battles that can swing on a single ruling. Because so much rides on how a jury receives dueling experts, the outcome is genuinely unpredictable, and that unpredictability is exactly what mediation is built to resolve. In private caucus I can walk each side through the realistic chance its experts carry the day, what a bad evidentiary ruling would do, and what the fight will cost to the verdict — and help both sides convert that uncertainty into a number they can accept.
