What actually happens during a mediation session?
A typical mediation begins with the mediator making introductions and setting ground rules, after which each side has an opportunity to explain its position and interests.
A typical mediation begins with the mediator making introductions and setting ground rules, after which each side has an opportunity to explain its position and interests.
The mediator then guides a discussion of the issues, and at various points may meet privately with each side in confidential sessions called caucuses, where parties are often more candid about what they truly need to resolve the matter.
The mediator carries offers and information between the parties as authorized, helping them narrow the gap.
The goal throughout is not for the mediator to decide who is right, but to help the parties reach their own voluntary, durable agreement.
