What issues commonly arise in developer and contractor
Disputes between developers and contractors, or among the various parties on a development project, commonly involve delays and their financial consequences, disputed change orders, cost overruns, allegations of defective or non-conforming work, disagreements over the scope of the contract, and payment and retainage disputes.
Disputes between developers and contractors, or among the various parties on a development project, commonly involve delays and their financial consequences, disputed change orders, cost overruns, allegations of defective or non-conforming work, disagreements over the scope of the contract, and payment and retainage disputes. Because these projects involve interdependent parties and substantial sums, a dispute can stall an entire development. Mediation is particularly effective here: a neutral experienced in construction and development can help the parties allocate responsibility and cost realistically and reach a resolution that lets the project move forward, which is usually far more valuable to everyone than a protracted fight that leaves the project stalled.
