Direct Answer

Yes. A FINRA mediation may occur before arbitration or while a FINRA arbitration is already pending. A matter submitted directly to mediation is commonly referred to as a "straight-in" mediation.

Importantly, submitting a pending arbitration matter to mediation does not automatically stay or delay the arbitration. Unless the parties agree otherwise, the arbitration continues while mediation is pursued. If all parties agree to stay the arbitration to mediate, however, the arbitration may be stayed while the parties attempt to resolve the dispute.

This flexibility allows parties to explore settlement through mediation without necessarily abandoning the pending arbitration process.
