Is there a deadline for bringing a securities claim to FINRA?
FINRA has an eligibility rule that generally provides that a claim is not eligible for submission to arbitration when six years have elapsed from the occurrence or event giving rise to the claim.
FINRA has an eligibility rule that generally provides that a claim is not eligible for submission to arbitration when six years have elapsed from the occurrence or event giving rise to the claim. Questions concerning whether a particular claim satisfies FINRA's eligibility rule are determined in the arbitration process.
The six-year FINRA eligibility rule is separate from applicable federal or state statutes of limitation, which may impose different or shorter time periods depending upon the nature of the claim. Accordingly, parties should not assume that they have six years to pursue every securities claim. The applicable timing requirements should be evaluated based upon the particular facts and claims involved.
